Terms of Use

1. Acceptance of the Terms

By accessing and using the Hotel em Dia platform (the "Platform"), you agree to these Terms of Use. If you do not agree, do not use the Platform.

2. Description of the Service

Hotel em Dia is software for audit checklists, operational audits and document expiry tracking for hotel chains and independent hotels. The Platform stores each hotel's documents and sends alerts before they expire, runs scored audits, turns the issues found into an action plan and shows the Operational Health Index of each hotel and of the chain.

3. Registration and Account

To use the Platform, you must create an account with true and up-to-date information. You are responsible for keeping your access credentials confidential and for all activities carried out in your account.

Each client chain has its own administrator, who invites the other users and sets the role and hotels of each one. The chain is responsible for the access it grants.

4. Contracting and Payment

• The commercial terms (features, fees and payment method) are presented in the proposal and confirmed when the contract is entered into.
• Under article 49 of the Brazilian Consumer Protection Code, where applicable, the contract may be canceled within 7 days, with a refund of any amounts paid.
• Any price changes will be communicated in advance and apply only to the following billing cycles.

5. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not:

• Use the Platform for illegal or unauthorized purposes
• Try to access restricted areas, or data of another chain or another hotel, without authorization
• Upload files, photos or other content without the right to use them
• Reverse engineer the Platform or try to extract its source code
• Overload the infrastructure through abusive use

6. Privacy and Data Protection

The processing of your personal data when you use the Platform is governed by our Privacy Policy, which is part of these Terms. By using the Platform, you acknowledge the data collection, use and protection practices described in it, in accordance with Law No. 13,709/2018 (LGPD, Brazil's General Data Protection Law).

For the personal data of the users that the client chain registers, and for the documents, audits, photos and other records it sends to the Platform, the client chain is the controller and HELPFLUX SOLUÇÕES EM TECNOLOGIA LTDA acts as the processor. The chain is responsible for having a legal basis for this processing and for the content it sends.

7. Intellectual Property

All content of the Platform, including but not limited to text, graphics, logos, icons, images and software, is the property of HELPFLUX SOLUÇÕES EM TECNOLOGIA LTDA or its licensors.

The documents, photos, audits, logos and other information that the chain registers on the Platform belong to the client chain.

8. Service Availability

We will make every effort to keep the Platform available 24 hours a day, 7 days a week. However, we do not guarantee that the service will be uninterrupted or error-free. Scheduled maintenance will be announced in advance whenever possible.

9. Limitation of Liability

The Platform is provided "as is". We are not liable for indirect, incidental or consequential damages arising from the use of, or the inability to use, the Platform.

Expiry alerts, audits and the action plan help the chain keep track of its obligations, but do not replace them: keeping licenses, permits, inspection reports and other documents valid with the competent authorities remains the responsibility of the chain and of each hotel.

10. Termination

We may suspend or terminate your account at any time, with or without cause, upon notice. You may close your account at any time by contacting us.

11. Changes to the Terms

We reserve the right to change these Terms at any time. Significant changes will be communicated through the Platform or by email.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the district of Santa Maria de Jetibá/ES are chosen to settle any disputes.
